YOU MAY USE IMAGES for personal use or as part of reselling something, including CD Labels & Covers, Letterhead, Tee-shirts, posters etc. as long as such use is not intended to allow the redistribution or re-use of the Image(s) themselves.

YOU MAY USE IMAGES As paintings or decorations in your home, office, public area, or store.

YOU MAY USE IMAGES For any electronic or print media, including advertising and editorial use, provided it is NOT intended to allow the re-distribution or re-use of the Image(s) themselves.

YOU MAY USE IMAGES So that you can modify or alter the Image(s) as necessary for your use. But the alterations must be substantial and not to allow for the redistribution or re-use of the Image(s) themselves.

PROHIBITED USES: YOU MAY NOT USE THE IMAGES FOR:

YOU MAY NOT Use the Image(s) to compete with DAK. DAK is in the business of selling Spacescape and other images to our customers. The specific intent of this provision to prohibit you from using the Image(s) to enter, either directly or indirectly, or through 3rd parties a similar or competing business utilizing the Image(s).

YOU MAY NOT Distribute, Sell, Sublicense, Transfer or assign the Image(s) or rights to the Image(s) to others for free, as a sale, license, trade or in any other way.

YOU MAY NOT Use the Image(s) in a product or service whereby the Image(s) can be used separately from a product or service which would be considered redistribution.

YOU MAY NOT Make the Images(s) available in any downloadable format where others may copy them.

YOU MAY NOT Use the Image(s) for any illegal or immoral purpose.

ADDITIONAL TERMS

DAK reserves the right to replace Image(s) with an alternative Image for any reason whatsoever. You agree to remove and replace any Image(s) that DAK replaces immediately and without recourse. You agree to no longer use any replaced Image(s) in any ongoing way.

PAYMENT TERMS
You agree to pay for all Images in advance and if for any reason a refund is issued, you agree to cease using the images and agree not to distribute them or use them in any way. You agree that a refund or return does not release you from your obligations in this agreement.

WARRANTY AND LIMITATION OF LIABILITY

DAK REPRESENT AND WARRANTS THAT:

3. To the best of DAK's knowledge the Image(s) as provided hereunder, will not infringe any copyright or any other intellectual property right of any third party.

THE IMAGE(S), ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. DAK DOES NOT WARRANT THAT THE IMAGE(S), WILL MEET YOUR REQUIREMENTS OR ARE ERROR FREE. THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE AND USE OF THE IMAGE(S) RESTS SOLELY WITH YOU. YOU UNDERSTAND THAT YOU SHOULD SEEK COUNSEL BEFORE USING IMAGES ON OR IN CONNECTION WITH ANY GOODS OR SERVICES OR FOR ANY OTHER COMMERCIAL PURPOSES. DAK SHALL NOT BE LIABLE TO YOU OR TO ANY OTHER THIRD PARY FOR ANY GENERAL, PUNITIVE, SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES, OR LOST PROFITS OR ANY OTHER DAMAGES, COSTS OR LOSSES ARISING OUT OF YOUR USE OR INABLITY TO USE THE IMAGE(S), DAK's BREACH OF THIS AGREEMENT EVEN IF DAK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, COSTS OR LOSSES. IN NO EVENT, SHALL DAK'S TOTAL AGGREGATE LIABILITY TO YOU, OR TO ANY THIRD PARTY ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE IMAGE(S) EXCEED THE AMOUNT YOU PAID DAK FOR THE IMAGE(S).

ENTIRE AGREEMENT
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, UNDERSTAND IT, ARE OVER THE AGE OF 18 AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. YOU FURTHER AGREE THAT IT IS THE COMPLETE AGREEMENT BETWEEN YOU AND DAK. THIS AGREEMENT CANNOT BE ALTERED BY VERBAL OR WRITTEN CORRESPONDANCE.
